Sonority Pty Ltd T/as Zipzip ("Zipzip") has a commitment to respecting your privacy and believes that privacy is an important individual right.
This Privacy Policy ("Policy") applies in relation to Zipzip's operations globally and explains how Zipzip complies with the Privacy Act 1988 (Cth) ("the Privacy Act").
This Policy relates to the collection, storage and use of information that is covered by the Privacy Act, being information or an opinion relating to an individual which can be used to identify that individual. This Policy is not intended to cover information that is not covered by the Privacy Act.
Background
Zipzip provides online software and related services. It is built, supervised and owned by Sonority Pty Ltd, a team that has specialised in providing analytical, technical, online software and related administrative services for the Australian Courts, law firms, litigation funders and other legal services sector participants for almost 20 years.
Sonority Pty Ltd is a registered Australian business. Where team members are located in other countries, they agree to adhere to the terms of this Policy and the laws of Australia.
General
Throughout this Policy, where you see words like "we", "our", and "us", we are referring to Zipzip and its team. Where you see words like "you" and "your", we are referring to you individually and/or the potential or actual Zipzip customers and related legal entities you are authorised to represent.
Collecting information about you
As a provider of online software for businesses, courts, law firms and not-for-profit and other organisations (our Customers), Zipzip generally does not receive nor collect personal information. We may receive information when you speak with us or send us correspondence on behalf of the business or organisation you are authorised to represent. If you contact us, we may keep a record of that contact.
Zipzip software has been built so that our team cannot access information that you (or any other person or legal entity related to your work that uses Zipzip software) add and/or upload (collectively Customer Data) without your express choosing. You may revoke this permission instantly at any time.
Zipzip cannot access any personal information held by our Customers without their express permission.
If a Customer grants any individual Zipzip team member access to its Zipzip online customer environment (OCE), their access is for the sole purpose of supporting, educating and training them in their use of Zipzip software.
Generally, the type of information Zipzip collects and holds about our Customers and its authorised representatives will include business registration information, name, mailing and email addresses, telephone number, job title and organisation/employer name. This information is collected in order to provide our products and services.
Zipzip does not collect sensitive personal information (e.g. information about someone's health, religion, or membership of a professional or trade association).
If you do not provide Zipzip with requested information, Zipzip may not be able to provide you with its products or services.
Zipzip may source non-personal information from a third party or source, such as from a publicly maintained record or from the public domain generally (e.g. internet or media).
Using and disclosing your information
Zipzip receives, holds, discloses and uses your information to:
- provide our products/services;
- keep you informed of developments that may be of interest to you;
- generally communicate with you;
- help us manage or improve our products/services;
- comply with legal obligations; and/or
- other purposes related to any of the above.
Zipzip may disclose your information to:
- other companies or individuals who assist us in providing you services or who perform functions on Zipzip's behalf; and/or
- anyone else to whom you authorise us to disclose it.
If Zipzip engages third parties to perform services for us, Zipzip prohibits the third party from using the information except for the specific purpose for which Zipzip supplies it and in accordance with this Policy.
Zipzip does not disclose any information it has received to third parties for any other purpose (such as allowing them to direct market their products and services).
Zipzip does not sell or trade information.
Accessing and correcting information we hold about you
You can contact Zipzip any time to request access to information you are authorised to request, which is generally found in your Zipzip Account section found in the Zipzip OCE if you have registered access. If you do not have access, please forward any information requests to hello@zipzip.me.
Unless an exception applies, Zipzip will, on request and within 28 days, provide you with access to the information Zipzip holds about you. Zipzip will provide you with access to your information in a manner requested by you (providing it is reasonable and practicable to do so).
If Zipzip is unable to provide you with access to the information, Zipzip will provide you with reasons and inform you of any exceptions relied upon under the Privacy Act (e.g. if your request is unreasonable or relates to legal proceedings including privilege or is otherwise unlawful). Zipzip will also provide you details of the process for making a complaint about the refusal to grant your access.
Zipzip will take appropriate steps to verify your identity to ensure that you are legally authorised before granting a request to access such information.
Zipzip will take reasonable steps to ensure that the information Zipzip collects about you is accurate, up-to-date, complete and relevant.
Storage and security of your information
Zipzip takes all reasonable steps to ensure that your information is kept secure. Your information may be stored in hard copy documents (least likely) and/or as electronic data in Zipzip's software and related systems (most likely). In the event that you grant access, Zipzip requires its employees to respect the confidentiality of any information in accordance with this Policy.
Customer Data is encrypted at rest by default using one or more encryption mechanisms. This includes all backup data and is stored on servers located in Australia. Customer data is also encrypted in transit in accordance with industry best practices as data moves to and from you and your team members' devices.
Encryption at rest is encryption that is used to help protect data that is stored on a disk (including solid-state drives) or backup media. All data that is stored by our online infrastructure provider is encrypted at the storage layer using the Advanced Encryption Standard (AES) algorithm, AES-256.
Websites and use of cookies
A cookie is a small data file that a website may write to your hard drive when you visit. A cookie file can contain information (such as a user ID) that the website can use to track the pages you have visited and your preferences. The only information a cookie can contain is information you personally supply. A cookie cannot read data from your hard disk or read cookie files created by other websites.
Zipzip uses cookies to understand how visitors use our website(s) and how customers use our online products/services.
Spam Act
Zipzip complies with the Spam Act 2003 (Cth) which regulates the sending of emails and other commercial electronic messages.
Effect of the Policy
This Policy does not form a contract between an individual and Zipzip. This Policy may change to reflect Zipzip's business, laws and technology. Whenever you need to refer to this Policy you should refer to Zipzip's website at www.zipzip.me or contact us for the most up to date version.
Please note that Zipzip's website may contain links to other websites. When a user has clicked on a link to another site, they leave the Zipzip site and are no longer protected by this Policy.
How you may lodge a complaint about privacy and how Zipzip will deal with the complaint
If you believe that Zipzip has breached a term of this Policy or the Australian Privacy Principles you may submit a written complaint to the Privacy Officer at hello@zipzip.me. You must include contact details for us to contact you regarding your complaint.
We will consider your complaint and respond as soon as reasonably possible, but not more than 28 days from receiving the complaint.
If you are unsatisfied with the outcome of your complaint you may ask the Privacy Officer to be referred to a higher authority within the company, such as Zipzip's Managing Director. If you still remain unsatisfied with the outcome, you may refer your complaint to the Office of the Australian Information Commissioner to be resolved (www.oaic.gov.au or telephone 1300 363 992).
